APPLICATION FOR GRANTING CERTIFICATE OF BASIC FOOD SAFETY CERTIFICATES

- Dossiers of application for certificates

A dossier of application for a certificate shall be made in 1 copy, comprising the following papers:

1. An application for a food safety eligibility certificate (made according to a set form).

2. Business registration certificate with registered food business (copy certified by the establishment).

3. Explanation of material foundations, equipment and tools to ensure food safety conditions (with certification by establishments), including:

a / A drawing of the plan of the ground design of the establishment and the surrounding area;

b) The diagram of the food production process or the process of preservation and distribution of products and explanations on the material foundations, equipment and facilities of the establishments.

4. Certificates of training of food safety knowledge of establishments and persons directly engaged in food production and trading:

a) For establishments with less than 30 persons: Submit copies of certificates (with certification of establishments);

b) For establishments with 30 persons or more: Submit the list of trained (certified by the establishment).

5. The health certificate of the establishment owner and of the person directly engaged in food production and trading; Report on the results of negative culture of pathogens causing intestinal diseases (cholera, dysentery and typhoid) of persons directly producing food in areas where exist diarrheal diseases according to the announcement of the Ministry of Health :

a) For establishments with less than 30 persons: Submit copies of certificates (certified by establishments);

b) For establishments with 30 persons or more: Submit the list of health examination results and faecal tests of establishments' owners and participants directly involved in food production or trading (certified by establishments). .

- Competence to grant certificates

1. The Food Safety Department issues certificates to:

Establishments producing and / or trading in functional foods, micro-nutritive foodstuffs, food additives and food processing aids, except for small production and business establishments; other food production and trading establishments when they have special needs (requirements of countries importing products of establishments).

2. The Food Hygiene and Safety Department of the provinces or centrally-run cities shall grant certificates to:

a / Establishments producing and / or trading in natural mineral water, bottled water, packings or utensils in direct contact with foodstuffs under the management of the health service in their respective localities;

b / Small-scale establishments producing functional food, fortified with micronutrients, food additives and food-processing supports.

d / Small-scale establishments trading in functional foods, micro-nutritive-enhancing foods, food additives and food processing aids, which require special preservation of products.

- Procedures for issuance of Certificate

The dossier-receiving agencies shall have to examine the dossiers, evaluate the establishments and grant certificates to the establishments satisfying food safety conditions. The procedures for granting certificates are as follows:

1. Judgment Examination:

a) Within 5 working days after receiving complete dossiers, the dossier-receiving agencies shall have to examine the validity of the dossiers and notify them in writing to the establishments if the dossiers are invalid;

If past 60 days from the date of receiving the notice of invalid dossiers, if the establishments fail to reply or supplement and complete the dossiers as requested, the receiving agencies shall cancel the dossiers.

2. Basic assessment:

a) After the results of examination of valid dossiers, the competent bodies shall have to evaluate the establishments within 10 working days. In case of delegation of power of appraisal to the subordinate agencies, written authorization is required;

b / The appraisal delegation of the establishment:

- The appraisal team shall be established by the competent agency that issued the certificate or the agency authorized to appraise it.

- Base inspection delegation consists of from 5 to 9 persons (for small food producers and traders from 3 to 5 persons), of which at least 2/3 of members are cadres Specialized food safety experts (experts may be invited to join the appraisal team).

- The head of the appraisal team shall take responsibility for the results of the evaluation of the establishment;

c) The contents of the evaluation of the establishment:

Collating information and verifying the legality of dossiers of application for certificates with original dossiers kept at establishments according to regulations; Verifying the food safety conditions at the establishments according to regulations and inscribing them in the minutes form issued together with this Circular.

3. Grant of Certificate:

a) In cases where an establishment meets all conditions for food safety as prescribed, the dossier-receiving agency shall issue a certificate, made according to a form issued together with this Circular. For seasonal food production and trading establishments, the duration of operation in the certificate must be clearly stated;

d) In cases where an establishment has not yet satisfied food safety conditions and has to wait for completion, the contents and time limit must be clearly stated, but must not exceed 60 days. The appraisal team shall organize the re-appraisal when the establishments issue a written certification that they have fully satisfied the requirements on food safety conditions of the previous appraisal team;

c / Where the establishments fail to meet the requirements
